Risk in the goods passes to the customer upon delivery, collection or handover to the freight provider, unless otherwise agreed in writing.

Customers must ensure that delivery details are accurate and that someone is available to receive the goods where required.

7. Collection

Where collection is arranged, goods must be collected during agreed business hours or appointment times.

The customer is responsible for safe loading, transport and securing of goods unless otherwise agreed in writing.

8. Product Use, Application and Safety

Stone Age Australia / Stone Age Tools is a supplier of diamond tools, blades, core drills, machinery accessories and related products only.

Customers are responsible for ensuring that the product purchased is suitable for their intended material, machine, application and operating conditions.

Diamond tools, blades, core drills and related products must be used only by trained and competent users, with appropriate equipment, water supply where required, safety procedures and personal protective equipment.

Customers must follow all manufacturer instructions, equipment instructions, safety guidelines and recommended operating practices.

9. Final Product, Material and Project Damage

Stone Age Australia / Stone Age Tools takes no responsibility for damage caused to the customer’s final product, material, slab, tile, paver, concrete, stone, equipment, machinery or project where the damage results from:

• Incorrect product selection;
• Incorrect application;
• Misuse;
• Operator error;
• Unsuitable machinery or equipment;
• Poor handling;
• Lack of water or cooling where required;
• Excessive pressure;
• Incorrect speed, RPM or feed rate;
• Improper installation;
• Failure to follow recommended operating practices;
• Use by an untrained or unsuitable operator.

To the maximum extent permitted by law, Stone Age Australia / Stone Age Tools is not liable for indirect loss, consequential loss, loss of profit, project delays, downtime, rework costs, material replacement costs, labour costs or damage to the final product arising from the use or misuse of any blade, tool or related product.

Nothing in this section limits or excludes any rights that cannot be excluded under Australian Consumer Law.

10. Product Recommendations

Any product recommendation, guidance or technical suggestion provided by Stone Age Australia / Stone Age Tools is general in nature and based on the information supplied by the customer at the time.

The customer remains responsible for confirming product suitability for their machine, material, site conditions, operator capability and intended application before use.

11. Returns and Refunds

Returns and refunds are handled in accordance with our Returns and Refunds Policy and Australian Consumer Law.

We are not required to provide a refund, exchange or credit for change-of-mind purchases, incorrectly ordered products or products no longer required by the customer.

Where a change-of-mind return is approved at our discretion, the product must be unused, in original packaging and in resalable condition.

A 30% restocking fee applies to approved change-of-mind returns.

The customer is responsible for return freight, handling costs and original delivery charges for change-of-mind returns, unless otherwise agreed in writing.

The 30% restocking fee does not apply where the product is faulty, incorrectly supplied, not as described, or where a remedy is required under Australian Consumer Law.

12. Warranties

Products may be covered by manufacturer warranties or supplier warranties.

Any warranty is subject to the terms provided by the relevant manufacturer or supplier.

Warranties may not apply where a product has been misused, modified, incorrectly installed, used for an unsuitable application, damaged after delivery, used outside recommended operating conditions or used by an untrained operator.

13. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, including loss of profit, loss of business, downtime, project delay, rework costs, labour costs, material replacement costs or loss of opportunity.

Where liability cannot be excluded, our liability is limited to the remedies available under Australian Consumer Law or other applicable laws.

You agree not to misuse this website, including by:

18. Special Orders and Custom Products

Special-order, custom-order or non-stock products may require upfront payment or deposit.

Unless required by law, special-order or custom products cannot be cancelled, returned or refunded once ordered from our supplier or manufactured.

19. Force Majeure

We are not responsible for delays or failure to perform caused by events beyond our reasonable control, including natural disasters, strikes, shipping delays, supplier delays, customs delays, transport disruptions, government restrictions, freight interruptions or other unforeseen events.
